General Terms and Conditions for Vendors

Booth size/Price:

  • The running meter costs €110.00 excl. VAT. Per table (dimensions 50x200cm). a ticket will be provided. The price applies to the entire event period.

Furnishing:

  • Tables and benches will be provided by the organizer. The organizer will provide a bench and a ticket for each table.
  • If more tickets are required, they must be purchased in advance or on site at the cash desk.
  • All furniture used, including tables and benches, must remain placed within the dealer area marked by the organizer during the event

  • Setup time: Thursday: October 19, 2023 10:00 a.m. – 7:00 p.m., Friday: October 20, 2023 9:00 a.m. – 1:00 p.m
  • Dismantling time: Sunday 22 October 2023 5:00 p.m. – 8:00 p.m

Opening times dealer area:

  • Friday, October 20 2:00 p.m. – 8:00 p.m
  • Saturday 21 October 10am-7pm
  • Sunday 22 October, 11am-5pm.

General booth information:

  • Exhibitors are not permitted to be in other areas at the same time, e.g. Artist Alley, 18+ Area, Cosplay Village etc. If this is the case, your registration will be immediately excluded.
  • Dismantling before the end of the official event times is not permitted.
  • If a stand has not been cleared by the end of the specified dismantling time, the organizer reserves the right to clear the stand at the expense of the exhibitor/dealer.
  • The organizer is not liable for damage caused by third parties or for theft of the goods.
  • The placement of goods and/or advertising material outside of the stand area is not permitted and may lead to extra costs or, if repeated, to exclusion.
  • The stand may not be passed on or rented to others without the written consent of the organizer!
  • Walls must not be taped over or damaged in any other way. Exceptions can be made after consultation
  • Exhibitors and dealers will be asked to dispose of the rubbish (generated in their area at the event).
  • The stand equipment must be returned in perfect condition after the end of the event.
  • Restoration and replacement of damaged, destroyed or lost items of furniture can only be carried out by the organizer and at the expense of the exhibitor/dealer. Pay particular attention to adhesive tape residues on the tables.
  • The stand area may not be changed (e.g. expanded) during the event. In case of violation, fees will be charged.

  • If extension cords or distribution sockets are borrowed, they must be returned at the end of the event, otherwise fees will be charged.
  • Advertising measures (e.g. flyers) are unrestricted on your own stand (within the framework of regular con operations), and in the event rooms only in consultation with the organizer.
  • After the end of the event, the retailer must leave the area he is using clean and swept. If this is not the case, the organizer reserves the right to charge for any necessary cleaning.
  • Special requests and inquiries (e.g. seat neighbor requests) must be made in WRITING without exception!
  • Exhibitors must always be of legal age and legally competent. A trade license is mandatory for participation in the event as an exhibitor. Separate rules apply to fan stands.
  • The organizer reserves the right to reject registrations without giving reasons.
  • The conclusion of the contract does not entitle the exhibitor/dealer to be allocated a specific space, but his wishes will be taken into account.
  • If a chip is required for the goods lift on site, it can be obtained from the information stand for a fee of €50. If the chip is returned at the end of the event, the retailer will be refunded the stake.
  • The exchange of stands between the authorized exhibitors/dealers requires the prior consent of the organizer.
  • Stand areas rented by the organizer may not be sublet or re-let.

Withdrawal/non-participation:

  • The organizer can agree to the termination of the contractual relationship up to 8 weeks before the start of the event, provided that the space that has become vacant can still be rented out elsewhere. In this case, the exhibitor has to pay 50% of the stand rent as a cancellation fee.
  • From 8 weeks before the start of the event or if the organizer does not agree to the termination of the contract, the exhibitor must pay the entire stand rent and the contribution to advertising costs as a cancellation fee.
  • The cancellation fee represents a lump-sum compensation, the reduction of which can be waived. The organizer does not have to accept a replacement tenant provided by the exhibitor.
  • If the stand cannot be occupied due to unforeseen events on the part of the exhibitor/dealer, the organizer must be informed immediately.
  • The stands that are not occupied at 12:00 p.m. on the first day of the event can be reallocated by the organizer to someone else. A claim for reimbursement of paid stand rent is excluded.

Products offered for sale:

  • The dealers themselves must ensure compliance with the applicable law for the products offered, in particular the protection of minors, the Accounting Act and the Cash Register Ordinance!
  • The sale of open and fresh food and drinks is not permitted.
  • The sale of weapons and weapon replicas is not permitted.
  • The sale of unlicensed products is prohibited. In the event of suspicion, the organizer reserves the right to demand proof of origin or a license agreement from the dealer.
  • The sale of rejected items can be prohibited by the organizer. In the event of repeated violations, the organizer reserves the right to have the stand cleared and to impose a ban on the dealer. An excluded merchant is not entitled to a refund of any costs.
  • In the event of gross violations, the organizer reserves the right to report this to the relevant authorities.
  • If you sell something other than the products listed above in the products offered for sale, the organizer is entitled to exclude the goods on site.
  • Unless otherwise contractually agreed with the organizer, the sale of tickets for other events of any kind is prohibited. The sale of Al Art products is also prohibited.

Protection of minors:

  • It should be noted that many of the event visitors are minors, which is why adult, violence-glorifying and pornographic goods may only be exhibited and sold in the 18+ area.
  • Goods that are not suitable for minors may not be handed out in public areas, even on request and against age verification.
  • Goods that are only permitted in the area of the 18+ stands also include nude motifs without an explicit sexual/erotic context, as well as images that are dressed in the most suggestive areas (e.g. lingerie, bikinis), but adopt provocative and/or sexually stimulating poses. The same applies to Ahegao products, as well as figures, mangas/doujinshis, artbooks and animes from the Yaoi, Yuri, Hentai, Horror, Splatter, Gore and sometimes Ecchi genres.

Payments:

  • Dealers must transfer the stand costs, according to registration, no later than 2 weeks after receipt of the invoice. This must be done by bank transfer. Account holder: Zlatko Hamzic; IBAN: AT192081500042410134; BIC: STSPAT2GXXX; Purpose: Dealer name + invoice number. Late payment will be considered a withdrawal from the registration.

Liability and insurance:

  • Insurance of items brought by the dealer against damage, burglary, theft, fire/water/transport damage is the sole responsibility of the dealer. The dealer is liable for damage caused to third parties or the organizer at the stand.
  • The organizer cannot be held liable for any damage caused by the use of its own stand equipment (including electronic devices).

Non-compliance with the conditions of participation:

  • If the conditions of participation are violated and continued despite a warning from the organizer, the organizer has the right to exclude the dealer from the event with immediate effect. An excluded vendor is not entitled to any reimbursement of costs. In the event of gross violations, the organizer reserves the right to report this to the relevant authorities.

Fulfillment and jurisdiction:

  • Place of performance and exclusive place of jurisdiction for all disputes between exhibitors/partners and the organizer is Graz. Austrian law applies to all disputes, including those with a foreign connection.

Partial nullity clause:

  • Should a provision of these Conditions of Participation be/become invalid or incomplete, this shall not affect the validity of the remaining provisions. In this case, the ineffective condition will be interpreted in such a way that it comes as close as possible to the originally intended purpose.
